The terms, in plain words.

1Agreement

These Terms of Service ("Terms") are between you and Elevated Systems ("we", "us"), the maker of Dozely. They apply to the Dozely app for iPhone and Apple Watch, its widgets and complications, and this website. By downloading or using Dozely, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Dozely.

Because you get Dozely from Apple's App Store, Apple's Licensed Application End User License Agreement also applies. These Terms add to it.

2Dozely is not medical advice

Dozely is informational and isn't a medical device. It can't diagnose, treat, cure or prevent any condition. Its scores, typical ranges, tips and patterns are general information, not medical advice and not a substitute for a professional's judgement.

Typical ranges shown in the app are broad general adult references, not personal targets. Patterns between your tags and your sleep are patterns in your own nights, not proof that one caused the other. If you're concerned about your sleep or your health, talk to your doctor. If you think you may have a medical emergency, contact your local emergency services.

3Who can use Dozely

You need to be able to form a binding agreement where you live to accept these Terms. If you're under the age of majority there, use Dozely only with the permission of a parent or guardian, who accepts these Terms for you. Dozely isn't directed to children under 13.

4Subscriptions and billing

Using Dozely requires a Dozely Pro subscription. Two plans are offered:

• Weekly: $8.99 per week
• Annual: $59.99 per year

Prices are in US dollars. The App Store shows the price in your country and currency before you buy, and that price applies.

• Billing. Payment is charged to your Apple ID when you confirm your purchase.
• Automatic renewal. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the current period ends.
• Cancelling. Manage or cancel your subscription any time in the Settings app (tap your name, then Subscriptions), or from Manage Subscription in Dozely's You tab. If you cancel, you keep access until the end of the period you've paid for.
• Refunds. Apple handles all payments and refunds. To request a refund, visit reportaproblem.apple.com. Refunds follow Apple's policies.
• Restoring. Use Restore Purchases in Dozely to restore an active subscription on a new device with the same Apple ID. You don't need an account.
• Price changes. If we change the price of a subscription, Apple will tell you in advance and, where required, ask for your consent before you're charged the new price.
• Introductory offers. Dozely doesn't currently offer a free trial. If an introductory offer is ever available, its terms will be shown clearly before you subscribe.

If your subscription ends, some features may no longer be available. Your data on your device isn't deleted.

5Your data and its accuracy

Dozely reads sleep and related data that your devices and apps save to Apple Health. Its results can only be as accurate as that data, and consumer wearables can be inaccurate. Dozely leaves out what a source didn't measure rather than guessing, and tells you when a score is based on fewer signals, but we can't guarantee that any reading, score or result is accurate or complete.

You're responsible for the corrections you make, for any corrected night you choose to save to Apple Health, and for any export you choose to share.

6Your license

We give you a personal, non-exclusive, non-transferable and revocable license to use Dozely on Apple devices you own or control, as allowed by the App Store's usage rules and these Terms.

7Acceptable use

Please don't copy, modify, sell or redistribute Dozely; reverse engineer it except where the law allows it; get around its subscription or security features; or use it in a way that breaks the law or harms others.

8Ownership

Dozely, including its design, score method, text, graphics and code, belongs to Elevated Systems and is protected by intellectual-property laws. Your data belongs to you.

9Apple

These Terms are between you and us, not Apple. Apple isn't responsible for Dozely or its content, and has no obligation to provide maintenance or support for it. Apple, Apple Watch, iPhone, Apple Health and the App Store are trademarks of Apple Inc. Dozely isn't made, sponsored or endorsed by Apple.

10Disclaimers

To the fullest extent the law allows, Dozely is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Dozely will be uninterrupted, error-free, or that it will improve your sleep or health.

11Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcomes, or decisions made based on Dozely. Our total liability for any claim relating to Dozely is limited to the amount you paid for Dozely in the 12 months before the claim.

Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

12Changes and ending

We may update Dozely and these Terms from time to time. If we make a significant change to these Terms, we'll update the date at the top and let you know in the app or on this website. Continuing to use Dozely after a change means you accept the updated Terms.

You can stop using Dozely at any time: cancel your subscription in Settings and delete the app. We may suspend or end your access if you seriously break these Terms.
